Signing the Agreement (Konveju)<\/span><\/strong><\/span><\/h1>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p class=\"p1\">When you find a property you wish to purchase you may want to negotiate the price, you can\u00a0either negotiate with the seller directly or if you are going through an estate agent you can\u00a0negotiate through them.<\/p>\n<p class=\"p1\">Once the price has been agree with the seller, your next step will be to sign a Preliminary\u00a0Agreement, this is known as a Konveju. The agreement is binding for both you (the purchaser)\u00a0and the seller of the property, it will specify the date when the purchase must be completed.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<h1><span style=\"font-size: 18pt; color: #808080;\"><strong>2. Paying the Deposit<\/strong><\/span><\/h1>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p class=\"p1\">A 1% provisional stamp duty payment will be required at this point, (this is a part payment and\u00a0the balance to make up the full payment of 5% will be required when the final deed is signed).\u00a0 You will also pay an agreed deposit, which is generally around 10% of the total purchase price\u00a0of the property.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<h1><span style=\"font-size: 18pt; color: #808080;\"><strong>3. On Completion<\/strong><\/span><\/h1>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p class=\"p1\">In the following few weeks the research to verify the legal title will be carried out by your notary,\u00a0they will also check that there are no outstanding debts on the property, hypothecs (the right of\u00a0a creditor to take a borrower&#8217;s property if a debt or obligation isn&#8217;t repaid), or liens. During this\u00a0time you will need to make sure that you have the finances in place for the purchase and that\u00a0you have any required permits, forms etc. that are required, (these will have been included in\u00a0the Konveju). The seller will fulfil any requirements for their side of the deal.<\/p>\n<p class=\"p1\">Once all parties have fulfilled their obligations the date will be set for the signing of the Final\u00a0Deed. Generally this is done at the offices of your notary or your banks legal offices. When the\u00a0Final Deed is signed the balance of the purchase price will be paid to the seller. The balances\u00a0which must be paid for stamp duty (to the Commission of the Inland Revenue) and the notary\u00a0fees (to the Notary Public), will also be paid at this point.<\/p>\n<p class=\"p1\">The property will now be officially yours and you will be handed the keys to you new home.<\/p>\n<p class=\"p1\">Legislation specifies that within 15 days of the date of the deed of transfer, your notary must apply for the property to be registered with the Land Registry (if the property is in a registration\u00a0area). This will be applicable for both first-time registrations and if the property has been\u00a0registered previously. For this your Notary will be required to present proof of ownership to the\u00a0Land Registry (this will include the legal documents for your claim, such as a deed, original\u00a0registration plan and a detailed plan).<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><strong style=\"color: #808080;\"><span style=\"font-size: 18pt;\">Malta Properties Taxation &amp; Costs <\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 18pt;\">On Malta There Are No Property Taxes Levied<\/span><\/strong><\/span><\/p>\n<p class=\"p1\"><strong style=\"font-size: inherit;\">Income Tax<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"p1\">All income earned by non-residents in Malta will be liable for tax and married\u00a0couples will be taxed jointly.<\/p>\n<p class=\"p1\">There is a withholding tax of 25%, which non\u2013residents are subject to, usually\u00a0this will be the final tax. The exception to this will be property income\u00a0(e.g.rental income), this will be credited to their tax liability on filing their tax\u00a0returns. The following progressive rates apply:<\/p>\n<p class=\"p1\"><strong>Income Tax for Non-Residents<\/strong><\/p>\n<p class=\"p1\"><strong>Progressive Rates:<\/strong><\/p>\n<p class=\"p1\">Up to \u20ac700 No Tax<\/p>\n<p class=\"p1\">\u20ac700 &#8211; \u20ac3,100 20% on the band over \u20ac700<\/p>\n<p class=\"p1\">\u20ac3,100 &#8211; \u20ac7,800 30% on the band over \u20ac3,100<\/p>\n<p class=\"p1\">Over \u20ac7,800 35% on all income over \u20ac7,800<\/p>\n<p class=\"p1\"><strong>Rental Income<\/strong><\/p>\n<p class=\"p1\">Progressive rates are incurred for rental income. The tax is calculated by the\u00a0gross rent minus the following:<\/p>\n<p class=\"p1\">\u2022 Ground rental and any rental which the owners must pay on the\u00a0property<\/p>\n<p class=\"p1\">\u2022 Any License fees which are levied in accordance with the Tourism Act\u00a0and the Malta Travel Act.<\/p>\n<p class=\"p1\">\u2022 Housing loans interest expenses<\/p>\n<p class=\"p1\">\u2022 An allowance will be made of 20% for the gross income which remains\u00a0after the license fees and rent have been deducted. 20%, the standard\u00a0allowance, covers repairs, costs and other related expenses.<\/p>\n<p class=\"p1\"><strong>Capital Gains<\/strong><\/p>\n<p class=\"p1\">Non-residents are obliged to sell their Maltese property to a Maltese citizen. If\u00a0they cannot either find a Maltese buyer or a citizen of the EU, only then is it\u00a0permitted for them to make the transfer to a foreign national.<\/p>\n<p class=\"p1\">Capital gains in Malta is a cost on the transaction rather than a tax on the gain\u00a0on the capital. It is generally 12% of the selling price or the transfer value.\u00a0The only fees that can be deducted from the selling price are the brokerage\u00a0fees.
